Recent News Regarding xAI’s Legal Action Against Apple and OpenAI

**Apple and OpenAI Request More Time, as Elon Musk Requests Additional Information**

Recent court documents indicate that Elon Musk is seeking information from an unnamed South Korean entity, while Apple and OpenAI have been provided with an extension to reply to Musk’s lawsuit.

US District Judge Mark Pittman has recently rejected a request from Apple and OpenAI to dismiss Musk’s lawsuit, highlighting the necessity for more evidence before a ruling can be made. Musk’s legal pursuit is based on allegations that Apple’s collaboration with OpenAI has established an uneven competitive landscape in the App Store, particularly impacting his AI firm, xAI, and its application, Grok. Musk asserts that this collaboration has obstructed Grok’s visibility and ranking in the App Store after a recent update.

In reaction to the lawsuit, Apple and OpenAI attempted to have the case dismissed, but their motion was declined, prompting them to ask for extra time to formulate their response. The court has allowed them until December 11 to submit this response.

In a significant update, the court has also sanctioned Musk’s request for an international judicial assistance order to procure evidence from a South Korean entity. This order, carried out under the Hague Convention, permits Musk’s team to gather information that may be critical to the case. However, the exact identity of the South Korean entity remains a secret. Speculations indicate it could involve major tech firms like Samsung or SK Hynix, which supply AI infrastructure to OpenAI, or Kakao, which has recently allied with OpenAI to incorporate ChatGPT into its well-known messaging application, KakaoTalk.

While the identity of the South Korean entity continues to be unknown, it is evident that the forthcoming weeks will be crucial for both Musk and the technology giants involved. Apple and OpenAI’s deadline to respond is approaching, and the repercussions of the evidence requested from South Korea could greatly influence the ongoing legal matters.
