Live Nation Intends to Challenge Monopoly Suit Verdict

The company is confident that the final outcome will be similar to its DOJ settlement. After a jury determined that Live Nation-Ticketmaster violated antitrust law on several counts, the company indicated in a blog post that the verdict is not the final decision on the matter. Live Nation plans to renew a motion for a ruling against the states, asserting they failed to prove their case legally. They are also awaiting a decision on a motion to dismiss the testimony of a states’ expert witness, whose analysis influenced the jury’s damages award. The jury found Ticketmaster overcharged consumers $1.72 per ticket. Live Nation intends to appeal any unfavorable rulings, according to the blog post. The jury’s damages are limited to tickets from 257 venues, which is 20% of total tickets. Live Nation argues that the up to $280 million pledged in its DOJ and states’ settlement will prove larger than the jury award. Judge Arun Subramanian is anticipated to rule on the final damages and other relief, possibly including a split, after a separate proceeding. The company maintains that the ultimate outcome will not differ significantly from the DOJ settlement.
